1. Introduction & Acceptance of Terms

Welcome to Better.ette, a demo-stage service provided by Betterette Global Sàrl-s. We have written these Terms in plain language — in line with EU Digital Services Act guidance for clear and user-friendly terms — so you know what to expect while trying our demo. By accessing the Better.ette demo or joining our waitlist, you agree to these Terms of Use and commit to following them. If you do not agree, please do not use the demo.

We appreciate you reading this document and we have tried to make it concise yet complete. These Terms apply to our current demo and feedback phase. If and when Better.ette transitions to a full product release, we will issue updated Terms of Use to reflect that new stage.

2. About Better.ette

Betterette Global Sàrl-s (referred to as "Better.ette," "we," "us," or "our") is a private limited company incorporated under Luxembourg law (a société à responsabilité limitée simplifiée), registered with the Luxembourg Trade and Companies' Register (RCS Luxembourg) under number B295703. Our mission at this stage is to test and improve the Better.ette platform with the help of our early users.

3. Eligibility

Age Requirement: You must be at least 13 years old to use the Better.ette demo. If you are located in the European Economic Area (EEA), you must be at least 16 years old, unless we have obtained verifiable parental or guardian consent for the processing of your personal data. Where the law of your country sets a different minimum age for digital consent, you must meet that age.

Our service is not directed to children, and we do not knowingly allow anyone under the applicable minimum age to participate. By using Better.ette, you confirm that you meet the age requirement that applies to you.

If you are a minor above the applicable minimum age, you must have parental or guardian consent before using this service, and your parent or guardian must review and agree to these Terms on your behalf.

We reserve the right to ask for proof of age or parental permission if needed and to disable access for anyone who does not meet these requirements.

4. Description of the Service

Demo Phase

Better.ette is currently offered as a demo version of our platform, available to a limited number of users via a waitlist. The service is provided for testing and feedback purposes, free of charge. This means the platform is still in development, may not be fully feature-complete, and might contain bugs or errors. We appreciate your understanding as you experience early versions of Better.ette's features.

Waitlist Access

During this phase, users may sign up to a waitlist. When invited, you will receive access to the demo application or site. There are no paid subscriptions, fees, or e-commerce transactions in this demo.

To use the demo, you may be required to sign in using a supported authentication method, such as a Google account, an Apple account, or email-based login. By signing in, you authorize us to receive and store the basic profile information provided by the authentication service (such as your name and email address), which we use solely for the purposes described in our Privacy Policy (see Section 8).

Social networking features (such as public profiles, friending, or content sharing between users) are not active in this stage, so your usage is primarily a single-tester experience.

Functionality

The Better.ette demo allows you to try out our core concept. For example, you might be prompted to complete certain "positive actions" or tasks and record your input. The exact features can change as we iterate on the product. We use third-party tools to support the demo, for instance, Brevo.com (an online form and survey tool) to collect waitlist data, and Supabase (a cloud backend service) to store application data, manage authentication, and support core platform functionality.

Supabase and Brevo.com act as technical infrastructure and service providers. They process data only on our instructions in accordance with applicable data protection laws and contractual safeguards. These services help us operate the Better.ette platform reliably and securely, but they do not control how we use or manage user data. You can learn more about Supabase at supabase.com.

All data collected through these tools is handled according to our Privacy Policy (see Section 8).

Data Persistence

Since this is a test version, data you enter may not be saved long-term. We may delete or reset demo data at any time without notice as part of development and iteration. Do not rely on the demo to store your only copy of any information. Likewise, availability of the demo is not guaranteed — we may limit access hours or suspend the service for updates. Once the demo phase ends, any remaining data will be deleted or anonymized within a reasonable period, subject to any legal retention obligations. We appreciate your patience and feedback during this period.

Not Professional Advice

Better.ette is designed as a behavioral encouragement and positive action platform. Any suggestions, prompts, or recommendations within the platform are informational and motivational only. They do not constitute professional advice of any kind, including medical, psychological, financial, or legal advice. You should not rely on the platform's content as a substitute for professional guidance. Better.ette is not a health or wellness service, and nothing in the demo should be interpreted as a diagnosis, treatment recommendation, or professional opinion. If you need professional support in any area, please consult a qualified professional.

5. Acceptable Use and User Responsibilities

We want Better.ette to be a positive, safe testing environment for everyone. By using the demo, you agree to use it responsibly and lawfully. Specifically, you commit to the following:

  • Follow the Law and Our Terms: Use Better.ette only for legitimate purposes. Do not use the service to engage in any illegal activities, and do not violate these Terms. You are responsible for any content or input you provide and for ensuring it complies with applicable laws and these rules.
  • No Harming or Hacking: Do not misuse our platform by introducing malware, attempting to breach security, or trying to access other users' data. You must not hack or disrupt the service's normal operation. Treat our infrastructure with respect.
  • Be Respectful and Kind: We do not tolerate harassment, hate, abuse, or any harmful behavior. Ensure that any text or content you input is appropriate. Do not use Better.ette to bully, threaten, or defraud anyone. Refrain from using any part of the service to post or transmit content that is defamatory, obscene, offensive, or invasive of someone's privacy. Be authentic, kind, and respectful — that is in the spirit of Better.ette.
  • No Intellectual Property Infringement: Do not upload or share content that you do not have the right to use. This includes not posting someone else's copyrighted material, trademarks, or confidential information through our feedback forms or any part of the service. Only provide content that you have the rights and permissions to share.
  • No Unauthorized Automation or Scraping: You must not use bots or automated scripts to access or collect data from Better.ette. Use the service through the provided interface only. Do not attempt to mass-download, scrape, or compile data from the demo.
  • Honest Use of Feedback Channels: When giving feedback or filling out surveys, please do so truthfully and in good faith. Do not spam our feedback form with irrelevant or repetitive submissions and do not submit false bug reports or misinformation. We welcome constructive criticism, but any abuse of the feedback system is not allowed.
  • No Exploitation or Commercial Use: You may not use the demo for commercial purposes. You must not resell access, advertise other products via our platform, or exploit the demo in any way to generate profit. Do not use the Better.ette demo to collect information about others for any kind of mailing list or advertisement.
  • Account Responsibilities: If you sign in to Better.ette using Google, Apple, or email authentication, you are responsible for maintaining the security of your login credentials and for all activity that occurs under your account. You agree to:
    • Provide accurate and truthful information when signing in
    • Not share your account access with others
    • Not impersonate any other person or entity
    • Notify us promptly at inspire@betterette.com if you suspect any unauthorized use of your account

Better.ette reserves the right to suspend or terminate accounts that violate these Terms or are suspected of misuse.

Reporting Issues: If you see something problematic, for instance illegal content or a security issue, please inform us at inspire@betterette.com. We aim to act promptly in removing or addressing any content or behavior that does not meet these standards, in line with our obligations under the EU Digital Services Act.

You are responsible for your own use of Better.ette. If you violate these rules or misuse the service, we may take action including suspending or terminating your access (see Section 10).

6. Feedback and User Input

One of the main goals of this demo is to gather your feedback and insights. We greatly appreciate you taking the time to share your thoughts on Better.ette. By providing any feedback, comments, ideas, suggestions, or other input (collectively, "Feedback") to us, you agree to the following:

  • Voluntary Feedback: You are providing Feedback on a voluntary basis, without any obligation for Better.ette to compensate you. You understand that we may or may not use the Feedback you submit, and we may combine it with Feedback from other users to improve the product.
  • Right to Use Feedback: You grant Better.ette a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to use, reproduce, modify, distribute, display, and otherwise incorporate your Feedback in our products and services for any purpose, without compensation to you. This means if you send us a great idea or report a bug, we can use that information to change our app, fix issues, or build new features. This grant does not affect your ownership of any underlying personal ideas — it is a license allowing us to benefit from what you share with us.
  • No Confidential Information: Please do not include confidential or sensitive information in your Feedback or in your positive action inputs. Any Feedback you give is considered non-confidential and non-proprietary.
  • Your Content Remains Yours: If the demo allows you to input content (such as notes on positive actions or entries in the app) that is not Feedback, you retain any ownership rights you have in that content. We do not gain ownership of what you write or create. However, by inputting content into the demo, you grant Better.ette a non-exclusive, worldwide, royalty-free license to use, store, display, and analyze that content solely for the purpose of providing the service and evaluating and improving our platform. This license ends when you delete your content or when the demo concludes, except as reasonably needed for our internal records or legal compliance.
  • Positive Actions Data: If the demo invites you to record "positive actions" or personal entries, those entries are primarily for your use and for us to understand user behavior in aggregate. We may review these inputs collectively to identify patterns or areas to enhance. We will handle any personal data in these inputs according to our Privacy Policy (see Section 8). Our acceptable use rules apply to all content entered in the app, including private inputs.

In short, we welcome your Feedback — it is invaluable to our development process — and by providing it, you allow us to use it to make Better.ette better. If you have any questions about how your Feedback or input may be used, feel free to ask us.

7. Intellectual Property Rights

Our Platform and Content: Better.ette (including the app, site, software, logos, design, and all content we provide) is protected by intellectual property laws, including copyright, trademark, and related rights. Betterette Global Sàrl-s (or its licensors) owns all rights in the Better.ette platform and brand. Using our demo does not give you ownership of any intellectual property in our service or content that you access. The Better.ette name and logo are our trademarks; you are not permitted to use them in a way not authorized by these Terms.

Demo License: We grant you a personal, non-transferable, revocable, limited license to access and use the Better.ette demo for its intended purpose — that is, to evaluate and give feedback on our product. This license is only for you and only valid during the demo period or until we revoke it. You may not copy, distribute, modify, or create derivative works from our platform or any part of its content, except as allowed under applicable law or with our written permission. You must not reverse-engineer, decompile, or extract source code from our software, except to the extent that such activity is expressly permitted by applicable law (including EU Directive 2009/24/EC on the legal protection of computer programs) and cannot be excluded by contract.

User Content: As described in Section 6, any content you input remains yours, subject to the license you grant us for operating and improving the service. Other than your own content, all materials on Better.ette are ours. You agree not to infringe our copyrights, trademarks, or other intellectual property rights, and not to remove or obscure any copyright notices or proprietary legends on content you access.

Confidentiality of Pre-Release Materials: If we share pre-release features, designs, materials, or other non-public information with you as part of your participation in the demo, you agree to treat such information as confidential. You must not disclose, publish, or share any such confidential information with any third party without our prior written permission. This obligation survives the termination of your access to the demo. General discussion of your experience with publicly available features of Better.ette is permitted, provided you do not use our trade name or images in a misleading way. If in doubt about what you may share, please ask us.

Infringement Reports: If you believe any material on the Better.ette demo infringes your (or someone's) intellectual property rights, please let us know immediately at inspire@betterette.com. We respect others' intellectual property and will address valid infringement reports promptly, including by removing content if necessary.

8. Privacy and Data Protection

Your privacy is very important to us. We handle your personal data in compliance with applicable laws, including the EU General Data Protection Regulation (GDPR) and Luxembourg's data protection regulations. Our separate Privacy Policy explains in detail what data we collect, how we use it, and how we protect it. Please review our Privacy Policy as it forms an integral part of these Terms. By using the Better.ette demo, you also agree to the data practices described in that Privacy Policy.

In summary, during the demo we may collect information such as your email address (for the waitlist and invitations), usage data from the app, and your feedback submissions. This data is used solely for operating the demo and improving our product. We will not sell your personal data or use it in ways you have not been informed of. Third-party service providers we use are bound by contractual agreements to handle your data securely and only on our instructions. If you sign in using a third-party authentication provider (such as Google or Apple), we receive basic profile information from that provider (such as your name and email address) as described in our Privacy Policy.

As a Luxembourg-based company, we are subject to Luxembourg's data protection supervision and the EU's high standards of privacy protection. In practice, this means we treat your data with care and store it securely. As described in Section 4, we may delete or reset demo data at any time during the demo phase as part of ongoing development. Once the demo phase ends, any remaining personal data will be deleted or anonymized within a reasonable period, unless retention is required by law or for legitimate operational purposes (such as security logs). If we continue development into a full product, we will provide updated privacy notices accordingly.

Because the Better.ette demo may have testers in multiple countries, your data may be transferred or accessed outside your country of residence (for example, if our developers or infrastructure are in another region). We ensure any such transfers are made lawfully, using EU standard contractual clauses or other appropriate safeguards as needed. See the Privacy Policy for full details on international data transfers, your rights (such as access, correction, or deletion of data), and how to contact us about privacy concerns.

If at any point you have questions about your personal data, you can reach out to us using the contact information in Section 13. If you do not agree with how we handle data as described, please do not continue to use the demo. We are committed to transparency — no surprises and no hidden practices in how we deal with your data.

9. Disclaimer of Warranties and Limitation of Liability

Because Better.ette is in demo form, it is provided "as is" and "as available" without any warranties of any kind, whether express or implied. We do not guarantee that the service will be perfect, uninterrupted, secure, or error-free.

Use of the Better.ette demo is at your own risk.

To the fullest extent permitted by law, we disclaim all warranties regarding the demo, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. While we will do our best to fix issues, the very purpose of the demo is to identify what needs improvement.

Limitation of Liability

Under no circumstances will Betterette Global Sàrl-s, or its directors, officers, employees, or agents, be liable for any indirect, incidental, special, or consequential damages resulting from your use of (or inability to use) the Better.ette demo. This includes, without limitation, damages for loss of data, loss of profits, or other intangible losses.

Given that the demo is free and experimental, and to the extent permitted by applicable law, Better.ette assumes no liability for issues such as temporary or permanent unavailability of the service, security breaches or bugs, inaccuracies or omissions in content, damage to your device or software, or any outcome from using the demo.

Sole Remedy

If you are dissatisfied with any aspect of the demo, your sole remedy is to stop using it.

Statutory Rights Preserved

Some jurisdictions do not allow certain warranty disclaimers or liability limitations. Nothing in these Terms excludes or limits liability beyond what the law permits. In particular, these Terms do not limit Better.ette's liability for fraud, intentional misconduct, gross negligence, personal injury caused by our negligence, or any other liability that cannot be excluded under Luxembourg law or other applicable mandatory law. If you are a consumer, your statutory rights remain unaffected.

No Reliance for Critical Purposes

The demo is not a final product. Do not rely on it for any critical purposes. Do not store your only copy of important information in the app, and do not rely on the demo for any health, safety, or time-sensitive purposes. No advice or information, whether oral or written, obtained from us or through the service creates any warranty not expressly stated in these Terms.

10. Termination or Suspension of Access

Since this is a limited demo, we reserve the right to terminate or suspend your access to Better.ette under the following circumstances:

  • Violation of Terms: If you breach any of these Terms (for example, by engaging in prohibited conduct described in Section 5), we may immediately suspend or terminate your use of the demo and remove any offending content. We will inform you of the reason for any such action.
  • Demo Conclusion: The Better.ette demo is not permanent. We may end the testing phase at our discretion and terminate all user access. We will make reasonable efforts to notify testers in advance (for example, via email) when the demo is closing.
  • Technical or Security Reasons: If we detect abnormal use that could harm our system or other users, or if we suspect that credentials have been compromised, we may suspend access while we investigate the issue.
  • Inactivity: If you are invited to the demo and do not use it for an extended period, we may remove your access to free up testing capacity for other users.
  • Legal or Regulatory Requirements: We may suspend or terminate access if required to do so by law, regulation, or a binding order from a competent authority.
  • Operational Necessity: Because this service is free and experimental, we may also restrict access where reasonably necessary to maintain the integrity of the test environment. In all cases, we will provide you with a clear explanation of the reasons for the restriction.

Effect of Termination: If your access is terminated or suspended, you will lose access to the demo and any data stored in it (which may be deleted). If you believe your access was wrongfully suspended, you can contact us at inspire@betterette.com to request a review. While we are not obligated to reinstate access, we will consider your request fairly.

Voluntary Discontinuation: You are free to stop using Better.ette at any time. You can also request deletion of any personal data you provided, as described in our Privacy Policy.

11. Modifications to These Terms

Better.ette is an evolving project, and these Terms of Use may be updated as the demo progresses or transitions to a new stage. We reserve the right to modify these Terms at any time as needed — for example, to cover new features, comply with new laws, or clarify provisions.

If we make changes that materially affect your rights or obligations, we will inform you clearly and directly before the changes take effect. For instance, we may send an email to active testers or display a notice in the app announcing updated Terms. In accordance with the EU Digital Services Act, we will provide reasonable advance notice of significant changes.

Whenever we update the Terms, we will update the "Last Updated" date at the top of this document. The latest version will always be available on our website. We encourage you to review the current Terms from time to time, especially if we notify you of changes.

If you continue to use the Better.ette demo after updated Terms have come into effect, that will constitute your acceptance of the new Terms. If you do not agree with the changes, you should stop using the service. If anything in an update is unclear, feel free to reach out for an explanation.

12. Governing Law and Jurisdiction

Governing Law

These Terms and your use of Better.ette are governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, without regard to conflict-of-law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

Informal Resolution

Before initiating any formal legal proceedings, we encourage you to contact us at inspire@betterette.com to attempt to resolve the dispute informally. We will make good-faith efforts to address your concern. If we cannot resolve the matter within 30 days of receiving your written notice, either party may proceed to formal proceedings as described below.

Jurisdiction

In the event of any dispute that leads to formal legal proceedings, the courts of Luxembourg will have non-exclusive jurisdiction. "Non-exclusive" means that if you are using Better.ette as a consumer in another country, this clause does not prevent you from bringing a claim in your home country's courts where you have the right to do so. EU consumer protection rules that grant you the right to resolve disputes in the courts of your country of residence remain fully in force.
